Terms of Service

Who may use the service

You must be at least 18 years old and able to enter into a binding agreement. You agree to provide accurate contact, billing, and reminder information and to keep it current.

The service

You Remembered provides personalized email or text reminders and gift or celebration ideas based on information you submit. Gift and celebration ideas are included with an active membership at no additional charge.

We work to deliver reminders reliably, but technology, carriers, spam filters, incorrect contact information, outages, and other circumstances can delay or prevent delivery. The service is an organizational aid, not a guarantee that a reminder will arrive by a particular time. You remain responsible for important dates, purchases, reservations, deadlines, and decisions.

Your submitted information

You keep ownership of information you submit. You give us permission to store, organize, and use it as reasonably necessary to provide and improve the service. When submitting information about another person, you confirm that you have the right to provide it and will not submit unlawful, harmful, or unnecessarily sensitive information.

Subscriptions and automatic renewal

The first 10 founding members may choose $9 per month or $90 per year. After the founding offer ends, standard membership is $12 per month or $120 per year. The price and billing interval are shown before purchase. Your selected membership renews automatically at the end of each billing period using the payment method on file until canceled.

Founding pricing remains available while the founding membership stays continuously active. If a membership is canceled and later restarted, the price available at the time of restart may apply. Taxes may be added when required.

Cancellation, plan changes, and refunds

You may cancel at any time through Member Tools or by emailing hello@consideritremembered.com. Cancellation stops future renewals. Details about effective dates, current-period access, billing errors, and refunds appear in our Cancellation & Refund Policy.

Communications

You authorize us to send transaction confirmations, account notices, and the reminders you request. If you select text reminders, message frequency varies and message and data rates may apply. Reply STOP to opt out of texts or use Member Tools to change preferences. Opting out of one delivery method may affect our ability to provide reminders through that method.

Acceptable use

You may not misuse the website or service; interfere with its operation or security; attempt unauthorized access; submit malicious code; impersonate another person; use the service for harassment, fraud, or unlawful activity; or infringe another person’s privacy or rights.

Ownership

The You Remembered name, website design, written content, and service materials are owned by You Remembered or used with permission. These Terms do not transfer any intellectual property rights to you.

Disclaimers and limits

The service and gift ideas are provided on an “as available” basis. Suggestions are informational and should be evaluated for the recipient, occasion, safety, allergies, budget, availability, and your circumstances. To the fullest extent allowed by law, You Remembered disclaims implied warranties and is not liable for indirect, incidental, special, consequential, or punitive damages.

To the fullest extent allowed by law, our total liability for claims related to the service will not exceed the amount you paid to You Remembered during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.

Suspension or ending service

We may suspend or end access for nonpayment, fraud, unlawful use, misuse, safety or security concerns, or a material violation of these Terms. If we discontinue the service without cause before the end of a paid period, we may provide a prorated refund for the unused portion.

Governing law and changes

These Terms are governed by the laws of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise. Before filing a claim, please email us so we can try to resolve the issue informally.

We may update these Terms as the service evolves. Material changes will apply prospectively, and we will provide notice when reasonably required. Continued use after the effective date of updated Terms constitutes acceptance.
